President Bingu wa Mutharika of Malawi has gone against public opinion and pardoned Steven Monjeza and Tiwonge Chimbalanga following a visit from Secretary-General of the UN, Ban Ki-moon.
The pair had been given 14-year jail terms for “gross indecency and unnatural acts” after announcing their engagement.
But a government minister told the BBC the men could be re-arrested if they continued their relationship.
